Supreme Court Issues Shocking Ruling In First Post-Scalia 2nd Amendment Case

"Conservatives have been worried about the sanctity of the Second Amendment following the death of Justice Antonin Scalia, a staunch gun rights advocate on the Supreme Court.

 
A decision released Monday, however, has been hailed a victory for gun rights, and conservatives everywhere will be relieved to see the court standing up for the Constitution even without Scalia.
 
The court overturned a decision out of Massachusetts that determined that stun guns were not covered by the Second Amendment, siding instead with a woman who said she carried one as protection against an abusive former boyfriend.
 
In an unsigned decision with no dissents, the country’s highest court ruled in favor of Jaime Caetano, who in 2011 was arrested for possession of a stun gun in violation of a state law banning such weapons. Caetano said she carried the stun gun for self-defense because her former partner was violent and abusive.
 
In March 2015, the Massachusetts Supreme Judicial Court ruled that the stun gun was not covered by the constitutional right to bear arms. The Supreme Court, however, decided that ruling was inconsistent with a 2008 Supreme Court decision declaring an individual right to bear arms."

$1,000 Gun Tax Pushed as “Role Model” for States

WASHINGTON, D.C. – A $1,000 per gun tax should serve as a “role model” for states, according to the governor of the U.S. territory of the Northern Mariana Islands, which imposed the $1,000 gun tax earlier this month. An idea first endorsed by Hillary Clinton in 1993, steep gun taxes have now taken hold in Cook County, Ill. the city of Seattle, and now a U.S. territory.

 

As reported by the Saipan Tribune:

 

The administration of Gov. Ralph DLG Torres defended the CNMI’s new gun control laws on Friday as a law that could be “a role model” for other U.S. states and jurisdictions facing seemingly uncontrolled and continued gun violence.

 

The administration was responding to queries regarding its position on recent reports that the a legal challenge to the new law, Public law 19-42, was likely, particularly over a provision that assesses a $1,000 excise tax on pistols.

 

The threat of such a tax serving as a role model for other politicians to impose is not an idle one. Consider the following:

 

Seattle Gun and Ammunition Tax: On Jan. 1, 2016, Seattle’s $25 per gun tax took effect, as did a two cent to five cent tax per round of ammunition. The new taxes have already forced at least one major gun dealer to leave the city.

 

Cook County, Ill. Gun and Ammunition Tax: On June 1, 2016, Cook County’s new ammunition tax takes effect, at a rate of one cent to five cents per round of ammunition. The ammo tax comes on top of the existing gun tax regime of $25 per gun.

 

Hillary Clinton’s 25% Gun Tax Endorsement: In passionate testimony to the Senate Finance Committee in 1993, Hillary Clinton gave her strong personal endorsement to a new national 25% sales tax on guns and endorsed a steep increase in the gun dealer fee, to $2,500. "I am speaking personally, but I feel very strongly about that,” said Clinton at the conclusion of her endorsement.

 

“The Left is now seeking to tax guns out of existence,” said Grover Norquist, president of Americans for Tax Reform. “The Second Amendment makes it difficult to legally ban guns, but Hillary has led the way to explaining you can achieve the same thing with high taxes.”

 

In newly released footage from Americans for Tax Reform, Clinton is shown nodding enthusiastically as she endorsed the 25% gun tax and as legal gun dealers were described as “purveyors of violence.”

Appeals court rules Americans don't have right to carry concealed guns

 

A federal appeals court in San Francisco ruled Thursday that people do not have a Second Amendment right to carry concealed weapons in public, in a sweeping decision likely to be challenged by gun-rights advocates.

 

An 11-judge panel of the 9th U.S. Circuit Court of Appeals issued the 7-4 ruling, upholding a state law requiring applicants to show "good cause," such as a fear of personal safety, to carry a concealed firearm.

 

The judges, further, definitively dismissed the argument that a right to carry a concealed weapon was contained in the Second Amendment.

Dems stage sit-in on House floor to push for gun vote

"Democrats are staging a sit-in on the House floor to push for action on gun control legislation.

 

Dozens of Democrats were participating in the sit-in shortly that began late Tuesday morning, with some lawmakers seated cross-legged on the floor.
Democrats have been pressing for action on gun control before the House leaves at the end of this week for a planned recess.
Rep. John Lewis (D-Ga.), the veteran lawmaker who was brutally beaten by police in the civil rights march on Selma, Ala., began the sit-in with a speech on the floor where he was surrounded by dozens of his colleagues.
 
"We have turned deaf ears to the blood of the innocent and the deaths in our nation," he said. "Mr, Speaker, where is the heart of this body. Where is our soul?
 
"How many more mothers, how many more fathers have to share tears of grief before we decide to do anything?"
 
Shortly after Lewis spoke, the Democratic lawmakers sat down in the well of the House. "

Gun Control Wall, Bolstered by Republicans, Shows a Crack

"WASHINGTON — A widely publicized sit-in by House Democrats. A bipartisan compromise proposal in the Senate. Neither is very likely to lead to any legislative action in Congress on gun safety this year. Election Day is too close, and most of the Republican opposition is too dug in.

 
But the fact that a legislative response remains elusive does not mean there has been no movement on the issue. Members of both parties say they sensed a shift in the gun debate after the mass killing in Orlando, Fla., a notable difference in attitude from the reaction on Capitol Hill after previous horrific shootings.
 
Eight Senate Republicans joined with 44 Democrats on a Republican-proposed compromise that would deny people on two different federal watch lists the ability to buy weapons unless they could successfully appeal that decision. Several other Republican senators showed some willingness to accept new restrictions on gun purchases if they could be structured in an acceptable way. A bipartisan companion measure also was introduced in the House.
 
These are incremental steps, but in the gridlocked world of gun control politics, they count for something.

Yes, by all means, let's use "terrorism" as the excuse for everything we do.  Been doing it for 15 years, and it's worked.  So how about we find out WHO the terrorists really are.  They only ones they will succeed in removing guns from, will not be the  "terrorists", but then we know the intent.

Open Mic Reveals Teleconference of East Coast Gov’t Agencies Planning Gun Confiscation...

The State’s Attorney’s General of Virginia, New York, Massacheusetts, and one other east coast state, along with DHS, FEMA and the A D L had a teleconference yesterday describing huge plans for gun confiscation in those states.

Amazingly, someone either risked their life or hit the wrong button because the supposedly private teleconference went out as open access to state and government agencies.

The plan was to use police and all the other agencies
listed
above to bull rush the gun owning citizenry and seize their guns and to do it very quickly so a counter operation wouldn’t have time to muster.

They then began to ridicule those who would be on the front lines in this operation and laughed at how easily they will be thrown under the bus.

Turns out some of the people being ridiculed were actually listening. It was police listening over their computers in their cars. Apparently they have made disks of the
2 hour
meeting and only distributing it to other trusted police members. The source of this story is Mark Koernke of The Intelligence Report at The Micro Effect and Liberty Tree Radio.

Apparently, the cops don’t want to release this publically because it could all be an op to see who would leak sensitive information.

This is not a drill. The Obama administration just implemented a new regulatory change that has sent the entire firearms industry into a tailspin overnight.

A key ingredient necessary for making gunpowder has been re-classified as a high explosive, making it illegal for any company within the industry to transport or store it as they have for decades.

It all stems from how the ATF regulates a chemical compound known as nitrocellulose. For decades, the firearm industry has been allowed to store and transport wetted nitrocellulose without having to treat it as a high explosive. Manufacturers deliberately mix the chemical compound with water to make it less volatile.

Overnight, the ATF just completely changed its regulations, turning everyone in the ammunition industry into felons if they do business the way they have for decades.

The entire industry is now at a standstill. Without nitrocellulose, you can’t make smokeless gunpowder. Without smokeless powder, there’s no ammunition.

This is the real deal. If this regulation stays in place, it will take months for the industry to recover and send ammunition prices through the roof!

Question - since only a small part of the nitrocellulose would be used for domestic ammo, with the rest being used mainly for military, plus a bit for export, what will happen to the military?

Student Suspended, Visited by Cops, Forced Psych Eval — For Pro 2nd Amendment School Project

 

Manville, NJ — Time out, lunch detention, and in-school suspension are all forms of discipline, among others, which teachers have employed to punish students for misbehavior. But after Frank Harvey, 17, a Manville, NJ, high school senior, completed a pro-2nd Amendment project, his school ordered him to get his head checked.

 

The incident began Monday after Harvey, as many students sometimes do, left his USB drive in the computer lab. Another student opened Harvey’s 11th-grade project and reported him to school officials.

 

At 7pm Monday evening, Harvey’s family said they were paid a visit by local law enforcement, who investigated Harvey’s claims the project was from last school year, and cleared him of any criminal mischief.

 

But that apparently wasn’t enough to satisfy the Manville School District who suspended and then promptly ordered Harvey to undergo a 5-hour psychological evaluation stemming from the months later discovery of his anti-gun control project.

ACTION PLAN: Trump’s Next Steps That Will Save Our Second Amendment!

"Donald Trump won the Presidency in a historic election, in one part due to his promise to save our Second Amendment and protect the right of American citizens to own a firearm.

Now it’s time to put that plan into action, and we couldn’t be more excited!

Trump’s “100-day plan” gives us the roadmap of what he’ll do right away in his first 100 days…or even first week….in office.

His “100-day action plan to Make America Great Again,” which he also called his “contract between myself and the American voter.”  So refreshing!

According to the plan, immediately after his presidency begins, Trump intends to take five actions aimed at restoring security for individuals in the nation, as well as constitutional rule of law. At the top of the list is to “cancel every unconstitutional executive action, memorandum and order issued by President Obama.”

Altogether – thus far – Obama has issued 249 executive orders during his eight years as president. Although reports indicate that when Obama meets with Trump to discuss his transition into the Oval Office, he will likely try to talk Trump into keeping those orders in place.

In addition, Trump said he will work to choose a replacement for former Supreme Court Justice Antonin Scalia, who died earlier this year. Trump has a list of 20 possible replacements, but noted that the replacement needs to be one “who will uphold and defend the U.S. Constitution.”

Trump’s plan also includes canceling federal funding to sanctuary cities – cities that typically house immigrants – as well as begin the process of “removing the more than two million criminal illegal immigrants from the country and cancel visas to foreign countries that won’t take them back.”

Lastly, in reference to national security, Trump’s plan includes suspending immigration from what he calls “terror-prone regions where vetting cannot safely occur.” He noted that all of those entering the United States from other countries should undergo what he calls “extreme vetting.”

Changes on Trump’s 100-day plan will be achieved through the following legislation: Middle Class Tax Relief and Simplification Act, End the Offshoring Act, American Energy and Infrastructure Act, School Choice and Education Opportunity Act, Repeal and Replace Obamacare Act, Affordable Childcare and Eldercare Act, End Illegal Immigration Act, Restoring Community Safety Act, Restoring National Security Act, and the Clean Up Corruption in Washington Act.

Will be interesting to see how much of his plan he's able to implement.

Also, I doubt that anyone of these people who are going around whinging, crying, protesting, rioting, repeating Hillary and media rhetoric, and being just plain unpleasant, closed minded and nasty have even read his 100 day plan. The only reason I saw it was because a link was posted here on Chani. I have not seen it once in my twitter feed.

I thought most of what he set forth sounded reasonable. Even when you look at his immigration plan, it's not what they keep repeating in the media and social media.

And now people are saying that since he's drafting insiders for his transition team, that he's not really draining the swamp. But if they look at his 100 day plan, they will see exactly what he meant by draining the swamp and ending corruption. It has nothing to do with who he has helping to run his administration. And certainly people don't expect him to have inexperienced people work with him. They already chastise him for not having any political experience.

It is really sad that people prefer to be spoonfed and manipulated rather than do their own research and thinking.

And people certainly don't understand Trump. I have watched him in amazement for decades. He is complex and a bit awkward. But he's very smart. I don't know why people discount that. And he's also a showman with a yuge ego. Lol. People take him and his antics too seriously. There are many subtleties about him that go unnoticed. He does not give up. Ever. He comes back from whatever circumstances. And he's definitely not a type to sit down and explain himself to anyone.

I suspect he is very excited about this new challenge. It's probably the kind of thing he thrives off of. The road will be tough, but I hope he can implement at least half of his contract fully.

The thing I have been feeling energetically around his being elected is that the stagnant, stuck energy has been broken up. We're no longer in a standstill. The energy is moving now and ripe to be guided and directed.

House Votes to Repeal Gun Ban for Military Veterans

On Thursday the U.S. House voted to repeal the gun ban for military veterans via the passage of the Veterans 2nd Amendment Protection Act.

This is the second major gun control bill that the House has voted to repeal since Barack Obama left office. They voted to repeal the Social Security gun ban on February 2, the Senate follow suit on February 15, and President Trump signed the repeal on February 28.

The Social Security gun ban was egregious because it portended a loss of Second Amendment rights without due process. The gun ban for military veterans is more of the same. It is structured so that military veterans receiving disability benefits can be investigated if their benefit check is sent to a third party to help manage finances; the premise is that if they need help managing finances they may be mentally unfit for gun ownership. But House Republicans and Second Amendment supporters have pointed out that requiring help balancing a checkbook or managing finances is a far cry from being dangerous with a firearm.

USA Today quoted NRA-ILA’s Chris Cox saying, “Receiving assistance to handle personal finances does not mean an individual is unable to safely own a firearm. Our brave men and women in the military should not be stripped of their constitutional rights without due process of law.”

The Veterans 2nd Amendment Protection Act is sponsored by House Committee on Veteran Affairs chairman Phil Roe (R-Tenn.). It passed by a vote of 240-175 and is designed to guard Second Amendment rights and the due process rights of military veterans. The NRA-ILA explained, saying, “The Veterans 2nd Amendment Protection Act would ensure that going forward, veterans who use a fiduciary would not be stripped of their constitutional rights unless a judicial authority first finds they pose a danger to themselves or others. This ensures due process rights for all veterans.”

Retired General David Petraeus and others are working with Gabby Giffords’ gun control group, Veterans Coalition for Common Sense, to pressure Republicans into preserve the gun ban for military veterans.

Ohhhh I tell you what! It has been a consensus for the CT heads in general that the USA citizens don't want to let go of guns for there's a serious risk that everyone gets done by the PWTB/gov/paramilitary/whoever else once people given up their guns.

This idea has been finally started to spread across the Japanese media, too! 

Finally!!

And people there are going "A-ha...now I see why"...

And it also shows that while what the US MSM still treating it as a "conspiracy" theory, Japanese netizens are accepting the understanding as the USA's reality smoothly, and not piffling on about it at all.

 

(You see, Japan had let go of the weapons in the same way hundreds of years ago, and people gave up on walking around with swords. People went "booooooooooooo!!!" full on then, but it had changed the path for Japan. It's a historical thing, and won't be able to apply it to the USA at all, for our situations are very different. )

Million Plus NJ Gun Owners Defy State Law, Refuse to Turn Over Banned Gun Mags

Over one million New Jersey Gun owners defy Governor Murphy's gun magazine ban & turn in demands of what some estimate is easily more than ten million now illegal standard capacity gun mags.

New Jersey –-(Ammoland.com)- New Jersey's standard capacity magazine ban is now in effect making New Jersey's one million gun owners criminals in the eyes of the state. But in an act of mass definace, New Jersey residents refuse to comply.

Any magazine holding more than ten rounds is now illegal in the Garden State. The standard magazine for an AR-15 holds 30 rounds. Glock 19s, which is the most popular pistol in the United States, holds 15 rounds. Anyone who is possession of larger magazine is committing a fourth-degree felony.

Anyone caught with one of the now banned magazines in their possession faces up to 18 months in prison and up to $10,000 in fines or both for each magazine found.
The bill was signed into law last June by Gov. Phil Murphy (D). Residents had until December 11th, 2018, to turn over magazines to police or sell or store them out of state.

Pro-gun groups sued New Jersey to try to prevent the law from going into effect. Their attempt on blocking the law failed in a federal appeals court. The three-judge panel ruled that a law limiting the number of rounds a magazine holds did not violate the US Constitution and did not put an undue burden on New Jersey gun owners."

Oregon Democrats push new bill to OUTLAW self-defense… protecting your family against violent crime is now a whole new crime

 

Senator Rob Wagner and Representative Andrea Salinas, two Democrat politicians in Oregon, have proposed a new piece of legislation to be taken up in the next legislative session that, should it pass, would steamroll the Second Amendment rights of Oregonians and make it all but impossible for them to defend themselves and their families against violent threats.

Senate Bill 501 would basically make it a crime for anyone living in Oregon to purchase a gun without first obtaining a government permit – also known as getting the government’s permission. It would also prohibit the purchase and possession of magazines that hold more than five rounds of ammunition, subjecting violators to up to one year of prison and/or thousands of dollars in fines.

Further, SB 501 would prohibit every individual from purchasing more than 20 rounds of ammunition in a 30-day period – the penalty for having a magazine that accommodates more than the allotted five round maximum being not only one year in prison but also a whopping $6,250 fine.

As reported by Steve Pomper from OpsLens.com, SB 501 would not just apply to people wanting to buy guns – it would also apply to people who already own them, meaning nobody with existing firearms, magazines, and ammo stores would be grandfathered in. In other words, SB 501 would instantly criminalize thousands of law-abiding gun owners in Oregon – which would seem to be every gun-hating Democrat’s dream.
